Preamble

Any order placed with Cadrazur implies unreserved acceptance of these general terms and conditions of sale, which cannot be derogated from under any circumstances, unless expressly agreed in writing.

ORDERS

Orders are accepted :

  • By post on plain paper or by pre-established order form by Label Art,
  • By phone, by fax, by Internet on our website https://www.label-art.com/en/

ORDER PAYMENT

Orders must be paid for in cash, using the various methods mentioned below:

  • by bank cheque, postal cheque or money order for written orders, with the exception of products offered in flash sales, all flash sales having to be paid for by credit card directly via the website.
  • by credit card for orders placed by telephone, on paper or via the Internet.
  • by Paypal for orders placed by telephone, on paper or via the Internet.

CONTRIBUTION TO POSTAGE AND PACKING FOR DELIVERIES IN METROPOLITAN FRANCE AND CORSICA

Postage and packing charges apply in Metropolitan France, excluding Corsica:

Small parcel delivery (your order does not include any bulky items): the price is estimated according to the weight and/or size of the parcel. A delivery charge of €6.90 is applied to all orders. Small packages are shipped by various carriers such as GLS, Colissimo or others. A tracking number is sent by e-mail on the day the order is dispatched, so that you can follow the progress and delivery of your parcel.

Your order contains at least one bulky item: the delivery charge will depend on the weight of your parcel. Large parcels are shipped by various carriers such as GEODIS, DHL or others. A tracking number is sent by e-mail. The day after shipment, the carrier contacts the recipient by e-mail to arrange a fixed delivery date. The recipient has 7 days to make the appointment. If, despite various reminders, the delivery appointment is not made within the given timeframe, the recipient will be liable for the cost of shipping and returning the parcel (as well as the cost of any re-delivery).

Bulky items are considered to be all those exceeding the size imposed by the carrier or your orders not being monocolis. Ex: Canvas rolls, frames and stretchers larger than size 20, easels, this list is not exhaustive.

SPECIFICITY OF THE ITEMS PRESENTED ON THE LABEL-ART WEBSITE

The photos and color charts presented in our catalog are not contractual. The photos are provided for illustrative purposes only. They cannot give rise to any dispute, call the order into question or engage our responsibility in any way whatsoever. There are no "standard" or "approved" norms for brushes and colors. The colors proposed in the compositions of boxes, sets, caskets and miscellaneous items are subject to change to allow the collections to evolve. Printing techniques, however efficient, may distort certain nuances. Wood is a living material; its original shade varies and influences its color and patina finish. Manual patinas are never strictly identical. We take great care to ensure the consistent quality of the products we describe.
However, we cannot be held responsible in the event of any error or computer error (e.g. prices at 0€ or negative, discounts close to or greater than 100%, this list not being exhaustive). It is obvious to the customer that this is a bug for which we cannot be held responsible. The order will therefore be cancelled and Label Art will reimburse any delivery charges on the item if these have been borne by the customer. Label Art will repair the bug as quickly as possible and notify its customer.

PRICE

All our prices are quoted in euros and include T.V.A. in force at the date of publication. We reserve the right to modify them in the event of a change in the exchange rate T.V.A. These prices remain in effect until the next price catalog is published. Cadrazur guarantees you the lowest prices with the "unbeatable price guaranteed" logo. If, within 30 days of your purchase from Cadrazur, you notice a price difference on an item ordered and appearing on your paid invoice, it is your responsibility to inform our sales department and send us proof of the price (invoice, quotation). We will then systematically reimburse the difference noted for any item sold under the same conditions, not benefiting from an exceptional discount or promotion limited in time, nor a sliding-scale discount, sold online on the Internet site only, by a company whose head office is located on French territory.

Operations associated with "promo codes" are only valid on the web. They are not cumulative with other current advantages. The promo code is entered directly in the shopping cart tab. This code is applicable only once during the given period and no promo code can be applied to the same customer account (same name, same address or same credit card number) during its validity period.

SHIPPING, RETENTION OF TITLE, CLAIMS

Upon receipt of the order, it is the customer's responsibility to note any reservations immediately upon receipt of the goods, mentioning on the carrier's delivery note any defects or damage noted, such as crushed, deformed, holed or stained packages....this list is not exhaustive. The reservations mentioned and/or any damage to the goods must be confirmed directly with the carrier, by registered letter with acknowledgement of receipt, within 48 hours of receipt, on pain of forfeiture. Please note: the words "subject to unpacking" have no value. Goods are only considered to have been acquired by the purchaser once the invoice has been paid in full, delivery in no way representing a transfer of ownership: law n°80335 of May 12 1980. Goods that do not conform to the order or are defective must be the subject of a written complaint within 48 hours of receipt. Upon receipt of the claim, Cadrazur will issue a file number. Defective goods or goods not conforming to the order must then be returned to Cadrazur within 15 clear days, unused and in the original packaging. Upon receipt of the returned goods, and subject to their actual defects, Cadrazur will, depending on the availability of its stocks, replace the defective items or reimburse them. Cadrazur will bear the shipping costs. For this purpose, it is imperative to contact Cadrazur by e-mail, mail or telephone, so that a return file can be opened. Cadrazur will then reimburse the return costs, upon presentation of a receipt showing the exact amount of the costs incurred. If the goods are not found to be defective, the cost of returning the goods to Cadrazur and the cost of returning the goods to Cadrazur shall be borne entirely and exclusively by the client. The customer shall be personally responsible for the replacement of any coaster glass broken during transport, and shall present Cadrazur with the duly receipted invoice for the replacement. Cadrazur will then reimburse the customer, up to a maximum of 10 euros (VAT included) per square metre replaced. Cadrazur will not accept packages sent by a customer with postage due. No claim will be accepted after 48 hours.

The Product(s) returned must be in their original packaging, in good condition, as delivered by the Vendor. In particular, the Product must not have been used improperly.

Except in cases where the legal warranty applies, any Product that is incomplete, damaged or whose original packaging has been damaged will not be reimbursed or exchanged.

COOLING-OFF PERIOD

All items can be retracted, exchanged or reimbursed, with the exception of frames, Art coasters and bare or canvas stretchers, as well as items that have been personalized at the customer's request. A request must be made via the contact form on our website and an acknowledgement of receipt will automatically be sent.

The item to be returned must be undamaged, complete and packaged.

The return or request for exchange by the customer must be made within 14 days from the date of receipt or collection of the parcel.

Article L121-20 of the French Consumer Code

The consumer has a period of 14 clear days to exercise his right of withdrawal without having to justify his reasons or pay any penalties, with the exception, where applicable, of the cost of returning the goods.
The period referred to in the previous paragraph runs from receipt for goods or acceptance of the offer for services.


If the 14-day period expires on a Saturday, Sunday or public holiday, it is extended to the next working day.

Reimbursement will be made within a maximum of 14 days from the date of receipt of the goods (reimbursement of the amount of the order + standard one-way shipping costs).

The cost of returning the product following retraction remains the responsibility of the consumer.

SETTLEMENT OF DISPUTES

In the event of a dispute and following the failure of a written complaint from the Buyer to the Seller or in the absence of a response from the Seller within 1 month, the Buyer may have recourse for 1 year to any alternative method of dispute resolution and in particular to a mediation procedure by contacting the following mediator: by e-mail xxx@xxxx or by post at XXXX.

The mediator will attempt, independently and impartially, to find an amicable solution to the dispute. The Buyer remains free to accept or refuse recourse to mediation and, in the event of recourse to mediation, each party is free to refuse the solution proposed by the Buyer"
